Terms of Use for Party Labels

Party Labels is a digital label creation tool owned and operated by Party at Mosswood ("we," "our," or "us"), a brand providing resources and tools to help people plan, organize, and elevate their gatherings. These Terms of Use ("Terms") govern your access to and use of the Party Labels website (https://www.partylabels.com and all related services, products, and tools (the "Service"). By using the Service, you agree to these Terms.

1. Account Registration

To use the Service, you must create an account. You agree to provide accurate and complete information and keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Subscription and Payment Terms

Party Labels offers a subscription-based service:

• Subscription fees are charged on a monthly or annual basis.
• New users may start with a 7-day free trial, during which no charges will apply.
• At the end of the free trial, your subscription will automatically convert to a paid monthly plan unless canceled before the trial ends.
• You may upgrade from monthly to annual at a different rate during your active monthly subscription.
• All payments are processed securely through our third-party payment processor. If a payment fails, your access to the Service may be suspended or terminated.

3. Cancellation and Refund Policy

You may cancel your subscription at any time via your account settings.

Cancellations prevent future charges but do not result in refunds for any unused portion of the current subscription period.

Refunds are only issued in exceptional cases and at our sole discretion.

• Subscriptions: We do not offer refunds on subscription plans since a 7-day free trial is available to try the product.
• One-Time Purchases: Select one-time purchase products may be covered under a full money-back guarantee, which will be clearly stated on the product sales page. If eligible, refund requests must be made within 14 days of purchase by contacting hello@partylabels.com.

4. Access and Usage Rights

Subscribers have access to unlimited label creation using all available templates, fonts, colors, and border designs.

You may use your labels for personal or professional events, including pop-ups and catered parties.

You may not redistribute or resell the digital templates or final designs without express written permission.

5. Ownership and Intellectual Property

All content, including templates, designs, fonts, and branding, are the intellectual property of Party at Mosswood and its licensors. By using the Service, you receive a limited, non-transferable license to use these materials solely for their intended purpose.

6. Sharing of Information

By signing up for Party Labels, you acknowledge that information provided will be shared with and managed by Party at Mosswood for customer service, product improvement, marketing, and administrative purposes.

7. Prohibited Activities

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for unlawful or fraudulent purposes
• Interfere with or disrupt the integrity or performance of the Service
• Upload content that is harmful, abusive, obscene, or infringing

8. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or engage in any prohibited activities.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted access, error-free performance, or suitability for your specific needs.

10. Limitation of Liability

To the fullest extent permitted by law, Party at Mosswood shall not be liable for any indirect, incidental, or consequential damages arising out of your use of or inability to use the Service.

11. Indemnification

You agree to indemnify and hold us harmless Party at Mosswood, its affiliates, and licensors from any claims, damages, or expenses resulting from your use of the Service or violation of these Terms.

12. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through informal negotiation. If unresolved, disputes will be settled through binding arbitration in Seattle, Washington.

13. Changes to the Terms

We may update these Terms from time to time. Any changes will be posted on this page, and continued use of the Service indicates your acceptance of the revised Terms.
